O objetivo deste artigo é apresentar uma argumentação sobre a possibilidade de se pensar a justiça como uma experiência do i m possível. Parte-se da distinção derridiana entre justiça e direito. Essa distinção trará algumas implicações no que tradicionalmente é entendido como ética. Partindo do jogo ou da différance marcada entre a presença/ausência, pretende-se estabelecer um ponto de diálogo entre Derrida e Levinas. O ponto de aproximação é a questão do terceiro na relação do face a face. Nesse sentido, problematiza-se (...) se a desconstrução pode ser adotada como um possível modo filosófico que fundamente a compreensão da justiça. (shrink)

Much controversy has emerged on the demarcation between legal positivism and non-legal positivism with some authors calling for a ban on the -as they see it- nonsensical labelling of legal philosophical debates. We agree with these critics; simplistic labelling cannot replace the work of sophisticated and sound argumentation. In this paper we do not use the term ‘legal positivism’ as a simplistic label but identify a specific position which we consider to be the most appealing and plausible view on legal (...) positivism. This is the view advocated by Gardner in his paper 'Legal Positivism: 5½ Myths’, where he carefully scrutinises the most convincing and unifying postulates of legal positivism, which he calls “the thin view”. The study shows that this thin view presupposes an empirical conception of action that is untenable and implausible since it makes acts of engagement with the law unintelligible to an observer of such acts. Objective: to determine the relationship between personal management and financial anxiety during COVID-19 times among residents of Northern Peru. Financial mismanagement, as a result of disorder in management and financial anxiety, leads to economic difficulties that can deteriorate citizens' health. Methodology: the approach was quantitative, of a basic type, at a descriptive correlational level, and included a sample of 360 residents from Northern Peru. Results: According to Spearman's Rho correlation, there is a negative correlation (r = -0.119) with a significance (...) of 0.024, which is less than 0.05. This indicates inadequate personal management knowledge that generated financial anxiety among the inhabitants of Northern Peru, due to the economic situation caused by the COVID-19 pandemic. Contribution: about health emergency, the risk and the possibility of knowledge in personal, social management warrants understanding the human person from various perspectives: economic, social, educational, legal, and political in a highly complex world. AntecedentsPrevious research on citizens’ reactions after terrorist events has shown that positive reactions can also emerge alongside pain and horror. Positive emotions have been widely associated with an abstract style of thinking. In the context of the Paris terrorist attacks in 2015, we explored Spanish citizens’ positive reactions – empathic concern, positive emotional climate, and esteem for humanity – and examined the relationships of these responses with an abstract style of thinking.MethodA longitudinal study was designed involving an online questionnaire that (...) was administered 10 days, 3 weeks, and 2 months after the attacks.ResultsEmpathic concern and personal distress toward Parisians decreased from the weeks following the attacks to 2 months later, with empathic concern always being more intense than personal distress. Emotional climate was perceived as more hostile than positive, although positive feelings persisted. People reported moderately positive esteem for humanity. Individuals with a more abstract style of thinking reported greater empathic concern, a more positive emotional climate, and more esteem for humanity.ConclusionsOur results support and extend previous research showing that abstraction enhances people’s resilience, even under traumatic circumstances such as those surrounding a terrorist attack. Evaluative markers of diminution and augmentation typically express quantity or intensity. Prior evidence suggests that they also convey emotions, although it remains unexplored as to whether this function is mediated by their role in expressing quantification/intensification. Here we investigated the effects of evaluative suffixes on the assessment of word affective properties by asking participants (N = 300) to score valence and arousal features for augmentatives, diminutives and base words with negative, positive or neutral valence. Diminutives and, to a lesser extent, (...) augmentatives were assessed more positively than base forms in negative words and more negatively than bases in positive words. The capacity of diminution to express attenuated emotions is in line with its function in conveying quantity. By contrast, valence effects for augmentatives suggests a role in expressing pejoration and amelioration that is not mediated by quantification. With regard to arousal, negative, neutral and positive augmentatives showed higher scores than base words, which, in addition, were also rated higher than diminutives. These incremental effects suggest that suffixes which convey larger quantity are also associated with increased arousal. Thus, with the exception of valence effects in augmentatives, it seems that evaluative suffixes encode both valence and arousal through quantification. (shrink)

In early 2020, the COVID-19 pandemic forced a large portion of the world into quarantine, leading to an extensive period of stress making it necessary to explore regulatory techniques that are effective at stimulating long-lasting positive emotion. Previous research has demonstrated that anticipating positive events produces increases in positive emotion during discrete stressors. We hypothesized that state and trait positive anticipation during the COVID-19 pandemic would be associated with increased positive emotions. We assessed how often participants thought about a future (...) positive/negative/neutral event, activity, or goal through a daily reconstruction method that represented a “day in the life” of people in the United States during the early stages of the COVID-19 pandemic. The results of multi-level modeling and mediational analyses demonstrated that higher optimism, one form of trait positive anticipation, was related to higher state positive anticipation, which was in turn related to higher positive emotions during the current episode, which persisted to the next episode. In addition, both optimism and state positive anticipation were related to adaptive responses to the pandemic. These findings suggest that anticipation of future emotional experiences and hopefulness for the future can be a powerful predictor of positive emotions during global pandemics and perhaps other similar chronic stressors. Ethical aspects of management control systems are attracting increasing attention among scholars and practitioners. Much of the work centers on their aims. We complement this scholarship by applying the ethical principle of “no harm,” i.e., non-maleficence, to examine how those aims are achieved. We illustrate this approach by exploring the effects of four MCS designs on job-related stress drawing on the differentiation of stress into two dimensions: a challenge and a threat dimension. Results from a lagged field-survey with 471 managers (...) and employees from the UK and the U.S. support key predictions and offer first insights into designing MCS based on a “no harm” ethics. Our study highlights the benefits of interdisciplinary research in business ethics and hopefully encourages more work on MCS from a perspective based on the non-maleficence principle. (shrink)

European firms are currently in a process of transition toward a circular economy, which is expected to guarantee sustainable growth over time. Developing eco-efficient practices is a necessary step in this transition. This study analyzes the impact of stakeholder engagement in a circular business ecosystem on the development of these circular eco-efficient practices. Past literature has evidenced the impact of stakeholder environmental pressure on firm strategic decisions and outcomes. We adopt the stakeholder theory from a more recent vision, arguing that (...) “shaking stakeholders up” within a circular ecosystem is a more advanced strategy than the traditional approach of reacting to stakeholder pressure. Using structural equation modeling, we examine the data of 14,726 European firms and their relationships with five primary stakeholder groups. The results offer theoretical and empirical support for the idea that firms can go further in adopting eco-efficient circular practices by shaking stakeholders up, selecting them, and managing relationships with them. Digital humanities research has developed haphazardly, with substantive contributions in some disciplines and only superficial uses in others. It has made almost no inroads in philosophy; for example, of the nearly two million articles, chapters, and books housed at philpapers.org, only sixteen pop up when one searches for ‘digital humanities’. In order to make progress in this field, we demonstrate that a hypothesis-driven method, applied by experts in data-collection, -aggregation, -analysis, and -visualization, yields philosophical fruits. “Call no one happy until (...) they are dead.” “De mortuis nil nisi bonum.” These ancient norms still inform how we speak of the dead. From their beginnings in the nineteenth century, modern obituaries have been both practical and honorary. They are written with two aims: to pay respect to the deceased and to inspire the living to follow in their footsteps. The obituary of William Custis of Virginia exemplifies these aims, say that “it is due to his memory publicly to record his virtues,” and that “There is in the life a noble, independent and honest man, something so worthy of imitation, something that so strongly commends itself to the approbation of the virtuous mind, that his name should not be left to oblivion” (Daily National Intelligencer, 18 November 1838). Likewise, philosophers have emphasized that we can determine what counts as a virtue for a given type of person in a given community by analyzing what people say about the dead (Zagzebski, L. Virtues of the Mind. Cambridge University Press, 1996, p. 135). By adhering to norms of praise, admiration, and respect, obituaries reveal what counts as a virtue, value, or constituent of wellbeing (VVC) for a particular type of person in a particular community. -/- One way to explore this insight would be to close-read a small number of obituaries of people from intersecting demographics, crossing dimensions such as gender, age, race, class, educational attainment, veteran status, religion, and location. Another, which we demonstrate in this chapter, is to harness digital humanities resources to distance-read a much larger number of obituaries, extracting both demographic meta-data and first-order content expressive of VVC. We then analyze and visualize this information to establish the structures of VVC associated with different types of people in different communities, arguing that data-science measures such as eigenvector centrality can be used to identify cardinal virtues. We also explain the rudiments of our text- and meta-data mining, our method of aggregating and comparing texts, and our visualization techniques. In so doing, we pave the way for researchers in philosophy and related fields to generate similar analyses and visualizations. (shrink)

El 24 de marzo en Argentina es una fecha en la cual se realizan en todo el país marchas y actos encabezados por las organizaciones de derechos humanos en conmemoración de las víctimas de la última dictadura cívico-militar iniciada en 1976. Sin embargo, durante los años 2020 y 2021 esta fecha estuvo signada por diferentes condicionamientos dado el Covid-19. En contexto de ASPO y DISPO, ¿qué memorias se activaron y pusieron a circular esos días? ¿Qué soportes y herramientas fueron fundamentales? (...) ¿Cómo fueron esos paisajes visuales de la memoria? ¿Cómo se conjugaron el activismo offline y el activismo online? Estas son algunas de las preguntas que se irán desentrañando a lo largo del texto. A partir del análisis, se observa una (re)configuración en los modos de hacer memoria colectiva que implicó nuevos desafíos a la hora de pensar su defensa/disputa y transmisión. Asimismo, hubo una renovación de las estrategias visuales desde las materialidades y formas y desde los modos de circulación, a la vez que se sumaron voces y luchas del presente que reavivaron el sentido de los trabajos de memoria para visibilizar problemáticas actuales y ampliar derechos que consoliden la democracia. While a large body of research has provided quantitative data on children’s levels of happiness, positive emotions and life satisfaction, the literature reflects a dearth of studies that analyze these dimensions from a narrative and qualitative point of view. Folk and fairy tales may serve as ideal tools for this purpose, since they are concerned with several concepts scientifically investigated by research in the field of positive psychology, such as resilience, self-realization, personal growth and meaning in life. The aim of (...) the present study was to explore children’s well-being and positive emotions using an innovative narrative approach, which involved interviews and group discussions, as well as the analysis of fairy tales written and discussed in a group context. The sample included 95 school children who were asked to report and discuss in a group setting situations or experiences which triggered positive emotions and happiness in them. Guided by their teachers and a school psychologist, they were then asked to write their own original fairy tale drawing on the positive emotions that had previously emerged. Positive emotions were found to be triggered mainly by interpersonal relationships with peers as well as with family members. Hobbies and leisure time were also strongly associated with happiness and hedonic well-being, while personal fulfilment, self-esteem and goal achievement emerged as highly significant for children. In sum, the findings suggest that this school psycho-educative intervention based on narrative strategies provided useful information on children’s well-being and yielded positive feedback, the implications and possible further applications of which are discussed. This dissertation is the first comprehensive study of human freedom in the philosophy of Pierre Gassendi, a 17th century natural scientist, Catholic priest, and one of the founders of Early Modern philosophy. The key postulate of this dissertation is that the epistemology of probabilism, which represents Gassendi's skeptical stance toward the possibility of certain knowledge, is also the foundation of human freedom: the uncertain and merely probable nature of all our knowledge serves as a guarantee of the multiplicity of options (...) open to us, and thereby ensures freedom. ;The first part of the dissertation investigates the sources on which Gassendi drew to elaborate his notion of freedom. The main sources are Aristotle's ethical theory and discussion of necessity, chance, and choice, as well as the Epicureans' theory of freedom. In conjunction with the latter, I consider the possibility that Gassendi conceives of the human mind---the seat of freedom---as corporeal, and thereby capable of generating autonomous developments on the basis of the natural motions of its atoms. ;The second part is devoted to studying Gassendi's epistemology of probabilism as the foundation of freedom. I look at the process of judgment that underlies choice, and consider the various manifestations of the freedom of indifference in the process of acquiring knowledge or preparing for a practical decision. I also look at the roles of the will and the intellect throughout these activities. ;The third part looks at theological issues in Gassendi's philosophy that relate to human freedom: divine concurrence with created beings, divine providence, and the limitations that faith imposes on the scope of our inquiry. ;The fourth and final part presents a study of Gassendi's ethics from the perspective of freedom. I investigate the role of temperament, passions, and opinions in human behaviour, and study the role of freedom in shaping these factors. In this volume, Veronica Roberts Ogle offers a new reading of Augustine's political thought as it is presented in City of God. Focusing on the relationship between politics and the earthly city, she argues that a precise understanding of Augustine's vision can only be reached through a careful consideration of the work's rhetorical strategy and sacramental worldview. Ogle draws on Christian theology and political thought, moral philosophy, and semiotic theory to make her argument. Laying out Augustine's understanding of the earthly (...) city, she proceeds by tracing out his rhetorical strategy and concludes by articulating his sacramental vision and the place of politics within it. Ogle thus suggests a new way of determining the status of politics in Augustine's thought. Her study clarifies seemingly contradictory passages in his text, highlights the nuance of his position, and captures the unity of his vision as presented in City of God. (shrink)

The introduction of new medical treatments based on invasive technologies has often been surrounded by both hopes and fears. Hope, since a new intervention can create new opportunities either in terms of providing a cure for the disease or impairment at hand; or as alleviation of symptoms. Fear, since an invasive treatment involving implanting a medical device can result in unknown complications such as hardware failure and undesirable medical consequences. However, hopes and fears may also arise due to the cultural (...) embeddedness of technology, where a therapy due to ethical, social, political and religious concerns could be perceived as either a blessing or a threat. While Deep Brain Stimulation (DBS) for treatment resistant depression (TRD) is still in its cradle, it is important to be proactive and try to scrutinize both surfacing hopes and fears. Patients will not benefit if a promising treatment is banned or avoided due to unfounded fears, nor will they benefit if DBS is used without scrutinizing the arguments which call for caution. Hence blind optimism is equally troublesome. We suggest that specificity, both in terms of a detailed account of relevant scientific concerns as well as ethical considerations, could be a way to analyse expressed concerns regarding DBS for TRD. This approach is particularly fruitful when applied to hopes and fears evoked by DBS for TRD, since it can reveal if our comprehension of DBS for TRD suffer from various biases which may remain unnoticed at first glance. We suggest that such biases exist, albeit a further analysis is needed to explore this issue in full. (shrink)

The aim of this study was to explore the existence of moral distress among nurses in Lilongwe District of Malawi. Qualitative research was conducted in selected health institutions of Lilongwe District in Malawi to assess knowledge and causes of moral distress among nurses and coping mechanisms and sources of support that are used by morally distressed nurses. Data were collected from a purposive sample of 20 nurses through in-depth interviews using a semi-structured interview guide. Thematic analysis of qualitative data was (...) used. The results show that nurses, irrespective of age, work experience and tribe, experienced moral distress related to patient/nursing care. The major distressing factors were inadequate resources and lack of respect from patients, guardians, peers and bosses. Nurses desire teamwork and ethics committees in their health institutions as a means of controlling and preventing moral distress. There is a need for creation of awareness for nurses to recognize and manage moral distress, thus optimizing their ability to provide quality and uncompromised nursing care. (shrink)
